ICE officers then questioned him without a lawyer or sign language interpreter present, attempting to use Google Translate to ask if he feared returning to Mongolia.
The main issue arose because border officials misunderstood Avirmed’s journey as being financed by someone named Virginia Washington, whom they thought was his daughter. In reality, he has no children, and it was a mix-up with names: his sponsor is actually his sister, who lives in Virginia.
Avirmed was subjected to a mental health evaluation without any explanation, which the judge criticized, ordering ICE to repeat the evaluation because the detainee must be able to understand and participate in all proceedings.
