General provisions will be governed by this law. Previously, the basis for insolvency was tied to a legal entity’s assets, but now, in line with international practice, the draft uses a mixed approach based on both cash flow and balance sheet methods. The draft also comprehensively revises the procedures for submitting, verifying, and satisfying claims to prevent negative practices such as claimants unjustifiably increasing their demands. To ensure equal protection of creditors’ rights and the participation of as many creditors as possible, the draft broadens the legal requirement for informing claimants. It also clarifies the requirements, rights, obligations, incentives, and appointment procedures for insolvency administrators, aligning with international standards. The draft law, therefore, not only regulates the termination and liquidation of insolvent legal entities, but also seeks to restore their activities through reorganization and prevent insolvency.
